Terms & Conditions

1. About ELARA

elaraworlds.com is operated by Daniel García trading as ELARA. Throughout these Terms, “ELARA”, “we”, “us” and “our” refer to Daniel García trading as ELARA. Contact us at concierge@elaraworlds.com.

2. Using our website

You may use this website for lawful personal or business purchasing and enquiry purposes. You must not misuse the website, interfere with its operation, or attempt unauthorised access.

3. Products and Worlds

ELARA specialises in luxury, freshly baked filled cookies containing chocolate ganaches, fruit-based fillings and delicate chocolate finishes. Our products are fresh, perishable pâtisserie rather than shelf-stable biscuits. Product descriptions, ingredients, allergens, weights and availability are shown on the relevant page. Please review this information before ordering and contact us if you need further information.

4. Batches and limited releases

Batch 001 is the first ELARA release and is limited to 100 boxes. Certain Worlds may be released for a specific Batch or limited period. Availability, return dates and future releases will be stated on the relevant product or collection page where applicable.

5. Pre-orders

Pre-order products are purchased before the relevant production or dispatch period. Estimated dispatch information will be shown during the ordering process. Batch 001 fresh baking is scheduled for 6–7 December 2026, with estimated UK express dispatch on 8 December 2026.

6. Prices and payment

Prices are shown in pounds sterling. Any applicable taxes and delivery charges are shown or calculated during checkout before payment. Payment is processed securely by the payment provider shown at checkout.

7. Order acceptance

Submitting an order does not create a contract until the order has been accepted and confirmed. We may decline or cancel an order where a product is unavailable, payment cannot be authorised, details are incomplete, or a pricing or description error is identified. Any payment taken for a cancelled order will be refunded.

8. Delivery and responsibility

ELARA orders may be personally delivered by our team or shipped using an approved delivery partner. Products are carefully prepared and packed using protective materials appropriate for their transportation. Where required, deliveries are made using refrigerated transport or suitable thermal packaging with cooling elements.

ELARA remains responsible for the goods until they are delivered to the customer or their nominated recipient, in accordance with applicable UK consumer law. Following delivery, customers are responsible for following the provided refrigeration and handling instructions.

ELARA cannot accept responsibility for deterioration caused solely by improper storage, exposure to heat or mishandling after delivery. This does not exclude responsibility for products that were already defective or unsafe upon delivery.

Delivery arrangements and estimated dates will be communicated during the ordering process. Customer rights relating to delayed or failed delivery remain unaffected.

9. Freshness, storage and enjoyment

Every ELARA cookie is freshly crafted in small batches using carefully selected ingredients. Our products are baked, rapidly chilled, finished and stored under refrigerated conditions before dispatch.

Customers must refrigerate their cookies immediately upon receipt and maintain a storage temperature of 5°C or below. Cookies must be consumed by the date printed on their packaging.

For the best experience, remove all packaging and gently warm an individual cookie in the microwave for approximately 10–15 seconds. Allow the filling to cool slightly before enjoying, as fillings may become hot.

Failure to follow the supplied storage instructions may affect the quality and safety of the products.

10. Cancellations and changes of mind

ELARA produces fresh, perishable pâtisserie in carefully planned batches. We do not offer discretionary cancellations, returns or refunds simply because a customer changes their mind, selects an unwanted flavour or no longer wishes to receive their order.

Where the statutory exemption for goods liable to deteriorate or expire rapidly applies, the standard 14-day cancellation right does not apply. Any statutory cancellation rights that do apply remain unaffected.

Customers wishing to amend or cancel an order should contact ELARA at concierge@elaraworlds.com as soon as possible, preferably before production begins. We will consider reasonable amendment requests where operationally possible.

11. Damaged, incorrect or defective orders

If your order arrives damaged, defective, incomplete or incorrect, please contact us within 24 hours of delivery, where possible. Our Returns & Refunds Policy explains what to include and how remedies are provided. The recommended 24-hour reporting period does not limit or remove your statutory consumer rights.

12. Food, ingredients and allergens

Ingredients and allergen information is available before purchase on our Ingredients & Allergen Information page. Our kitchen handles allergens. If you have a food allergy or need further information, contact us before ordering.

13. Product appearance

Each World is finished by hand. Photographs represent the finish we aim for, but small variations in colour, shape and finish may occur without affecting the product’s essential character.

14. Promotions

Promotions are subject to any terms stated with the offer. Unless stated otherwise, promotions cannot be combined, exchanged for cash, or applied retrospectively.

15. Gifting and business orders

Business, event and gifting orders may be subject to a separate quotation, minimum quantity, production schedule and delivery arrangement. Any additional terms will be provided before an order is accepted.

16. Website content and intellectual property

The ELARA name, branding, photographs, copy, designs and other website content belong to ELARA or its licensors. They may not be copied, adapted or used commercially without permission.

17. Liability

We do not exclude liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of rights that cannot legally be limited. Subject to those rights, we are not responsible for losses that were not reasonably foreseeable when the contract was formed.

18. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to reduce the effect and keep affected customers informed.

19. Changes to these terms

We may update these terms to reflect legal, operational or service changes. The terms in force when an order is accepted will apply to that order unless a change is required by law.

20. Your statutory rights

Nothing in these terms excludes, restricts or overrides your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation.

21. Governing law

These terms are governed by the laws of England and Wales. Consumers may also have the right to bring proceedings in the part of the United Kingdom where they live.
